Agreement
These Terms of Service are between you and Relephant Inc., an Ontario, Canada corporation. They govern your use of Pay My Nanny at paymynanny.ca. By creating an account, accessing the app, or using the service, you agree to these terms.
If you use the service for a household, family, trust, corporation, or another person, you represent that you are authorized to do so.
What the Service Does
Pay My Nanny provides software for Ontario household employers to record nanny payroll, calculate payroll estimates, organize CRA remittance reserves, prepare T4 draft records, and set up payment workflows through Stripe.
The service is a workflow and recordkeeping tool. It does not replace professional advice or your obligations as an employer.
Accounts and Security
You must provide accurate account information, keep sign-in credentials secure, and promptly tell us about unauthorized access or suspected compromise.
You are responsible for activity under your account and for ensuring that anyone you invite or authorize uses the service appropriately.
Payroll and Tax Responsibility
You are responsible for confirming employment classification, wage rules, vacation pay, CRA payroll account requirements, CPP, EI, income tax withholding, remittance timing, records of employment, T4 filing, and any other employer obligations that apply.
Calculations, reminders, reserves, T4 drafts, and dashboard amounts are provided for workflow assistance and may be incomplete, delayed, or inaccurate. You must review all payroll, tax, filing, and payment information before relying on it.
The service does not provide legal, tax, accounting, payroll compliance, financial, banking, or employment advice.
Payments
Stripe handles bank payment method setup, mandates, connected account onboarding, payment processing, and related compliance workflows. Payment capabilities may require Stripe approval, identity checks, risk review, and completion of Stripe account requirements.
You authorize payment instructions you submit through the service. Payments may fail, reverse, return, be delayed, or be unavailable depending on bank rules, Stripe requirements, account status, risk review, insufficient funds, incorrect recipient details, or legal restrictions.
You are responsible for confirming payee information, payment amounts, pay dates, and sufficient funding before submitting a payment batch.
T4s and Documents
T4 and document features generate draft records from information saved in the app. Unless we expressly offer and agree to a separate filing service, you are responsible for reviewing, issuing, and filing all forms and records with the correct authorities and recipients.
Fees
Running payroll requires a paid subscription through Stripe Billing. We will show applicable subscription, transaction, platform, or processing fees before purchase or activation. Third-party provider fees, bank fees, return fees, and taxes may apply.
Acceptable Use
You may not misuse the service, attempt unauthorized access, interfere with security, submit false or unlawful payment instructions, use the service for non-household payroll without permission, upload malicious code, or violate laws, provider rules, or third-party rights.
Third-Party Services
The service relies on third-party providers, including Clerk, Supabase, Stripe, and Railway. Your use of payment, authentication, billing, hosting, and database features may be subject to those providers' terms, policies, restrictions, and availability.
Availability and Changes
We may modify, suspend, limit, or discontinue features at any time. We may also update calculations, workflows, providers, and user interface behavior as laws, product requirements, or provider capabilities change.
The service may be unavailable because of maintenance, incidents, provider outages, network issues, or events outside our control.
Disclaimers and Limitation of Liability
The service is provided on an as-is and as-available basis. To the maximum extent permitted by law, we disclaim warranties of accuracy, completeness, fitness for a particular purpose, uninterrupted availability, and error-free operation.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, payroll penalties, tax penalties, payment failures, bank fees, or employment disputes arising from your use of the service.
Termination
You may stop using the service at any time. We may suspend or terminate access if we believe you violated these terms, created legal or security risk, failed provider requirements, or used the service in a way that could harm users, providers, or the platform.
Governing Law
These terms are governed by the laws of Ontario and the federal laws of Canada that apply there, without regard to conflict of law rules.
